My lease states i share the garden with downstairs, their lease makes no mention of the garden, what do i do?

when i bought the property i was told it was a private garden, upon seeing the lease i questioned it and was told that the downstairs lease makes no mention of the garden, so they have no rights over it.


Who do i approach to get the leases changed so they don't contradict each other, as i want to sell but don't want to mislead anyone like i was, is it the freeholders responsibility?

The freeholder (or his solicitor) is the person to sort this out. If no joy, try contacting the Leasehold Advisory Service (in London, google them) who were set up by the government to give free legal advice on all aspects of Leasehold law. Good Luck

Reply:Your question is ambiguous. First you say you lease the property then you talk about when you bought the property. Are you renting or buying? Do you know?


This sounds like a multifamily dwelling in either case condo or similar. The grounds of a condo building are common areas shared by all residents. Read the by-laws.
